LINCOLN, Neb. (AP)---A case stemming from the 2002 death of a 17-year-old Bridgeport girl in a boating accident will be heard Friday by the Nebraska Supreme court.
Samantha Rader was killed after being struck by a personal watercraft driven by teenager Skylar Panek while riding on a tube pulled by a boat at the Bridgeport State Lakes.
Galen Catron, the boat's operator, filed lawsuit seeking damages for emotional distress from having to witness the accident and taking Rader's battered body to shore. Morrill County district judge Paul Empson denied the claim, saying case law prevented such damages unless Catron also was physically injured.
But Catron's lawyer, Maren Chaloupka of Scottsbluff, argues that it's time for the legal standard to change.
The suit names Panek, jet ski owner Marvin Lewis for not providing proper training to the Arvada, Colorado youth before he operated the watercraft, and the state of Nebraska for failing to put in place regulations that allow for the safe operation of both boats and jet skis at Bridgeport State Lakes.
