The U-S Senate has confirmed Nebraska Supreme Court Justice John M. Gerrard to be U.S. district judge for the District of Nebraska. The bipartisan vote was 74-to-16.
Nebraska senators Ben Nelson and Mike Johanns had pushed hard for confirmation for Gerrard, named to the Nebraska Supreme Court by then Governor Nelson in 1995.
Johanns, a Republican, says he's pleased his Senate colleagues recognized that Justice Gerrard is "a highly disciplined judge who has distinguished himself throughout more than a decade of service" on the state's high court.
Nelson, a Democrat, led the floor effort for confirmation, telling his fellow senators that Gerrard "will do an exemplary job as a U.S. district judge."
Nelson said his only litmus test for a federal judge is whether they will follow the laws passed by Congress or take an activist stance on issues, and that Gerrard easily passed the test.
He said Gerrard's track record on the Nebraska Supreme Court and his public comments show that he believes only the U-S Supreme Court interprets the U-S Constitution.
The 58-year old Gerrard is a native of Schuyler and served as a private attorney, city attorney, and counsel to several public schools before being named to the state's high court.
He received the 2006 Distinguished Judge for Improvement of the Judicial System award from the Nebraska judicial system for his work on initiatives promoting racial and ethnic fairness, and the Nebraska State Bar's 2008 Legal Pioneer Award for helping make the courts more user friendly for all cultures.
Gerrard will replace Judge Richard Kopf, who took part-time senior status on December 1st after 19 years as a federal District Judge.
