A civil lawsuit against the city of Chadron and a Chadron police officer alleging excessive force has been dismissed because there has been no action in the case in more than two years.

Elizabeth Anderson and her son, Jeremy, filed the case after the boy's arrest in July 2007 on burglary charges.

The lawsuit contended the use of excessive force by a Chadron police officer and caused injury. The court papers indicate Anderson allegedly suffered injuries including but not limited to his ribs, left knee, elbow and ear.

The burglary charge for which Anderson was arrested was dismissed in February 2008.

The court dismissed the lawsuit without prejudice, meaning the Andersons could re-file at a later date.
