LINCOLN, Neb. (AP) - The Nebraska Supreme Court has upheld term limits for state lawmakers.
The court ruled today that those who filed the lawsuit failed to prove that the state's term limit amendment significantly interfered with their First Amendment rights of expression. Constituents of Senator Ernie Chambers of Omaha and former Senators Dennis Byars of Beatrice and Marian Price of Lincoln filed the lawsuit.
The three senators tried to file for re-election earlier, but were rejected by Secretary of State John Gale.
About 56 percent of Nebraska voters approved the state constitutional amendment in 2000. The rule limits senators to serving two consecutive four-year terms.
Twenty of the state's 49 senators could not run this past November. Sixteen more will not be able to run in 2008.
The rest of the 49 will be gone by 2012.
